Only a day after posting a story questioning Democratic candidate Dave Min, a person with his campaign has threatened to seek legal action.
However, when South OC Times returned Orrin Evans’ call and asked to clarify any factual errors, he would not point to any one factual error in the story. Evans said he was more concerned with the tone of the story.
Defamation has been proven a difficult legal battle for those who have engaged in it, given the nature of the First Amendment.
Min is currently running in California’s Senate District 37, challenging Costa Mesa Republican John M.W. Moorlach.
The story in question was regarding a supporter of Min’s campaign in 2018 when he was running for California Senate’s 45th District.
In the primary of the 2018 race, a supporter of Min’s called his opponent, Katie Porter, “Katie ‘Restraining Order’ Porter” on Twitter.
Porter, a domestic abuse survivor, told HuffPost the comments made by Kevin Matthews, a man she had never met, were likely made because she had a protective order against her now-ex-husband after he abused her prior to their divorce in 2013.
