Congressman Darrell Issa, representing California's 48th district and serving as Chairman of the House Judiciary Subcommittee on Courts, Intellectual Property, and the Internet, has introduced new legislation aimed at curbing the misuse of AI-generated digital replicas. The Preventing Abuse of Digital Replicas Act (PADRA) seeks to protect individuals' voices, images, and likenesses from unauthorized commercial use.
Rep. Issa emphasized the increasing risks associated with artificial intelligence as it becomes more integrated into daily life. "PADRA ensures that innovators and creators can protect their voice, image, and likeness from unauthorized use," he stated.
The proposed legislation marks a significant step in safeguarding personal identity in an era dominated by AI technologies. PADRA aims to establish federally recognized protections against the misuse of digital replicas for commercial purposes. It specifically targets deceptive practices that confuse consumers regarding endorsements or affiliations.
The bill proposes adaptations to existing trademark law under the Lanham Act to minimize uncertainties related to scope and interpretation. Additionally, it empowers individuals to enforce their rights without imposing additional costs on taxpayers or hindering U.S. innovation in AI technology.
Congressman Ben Cline highlighted concerns over deepfakes misleading consumers using examples like Tom Hanks and Lainey Wilson: "This vital legislation empowers individuals to protect their identities." Meanwhile, Congressman Jay Obernolte praised PADRA for its balance between preventing exploitation and preserving First Amendment rights.
Industry leaders have expressed support for PADRA. Scott Belsky from Adobe noted its importance in ensuring responsible AI use: "Adobe has been advocating for a federal anti-impersonation right." Similarly, Mitch Glazier of RIAA thanked Rep. Issa for his commitment to protecting artists against digital replica misuse.
Other organizations such as Business Software Alliance (BSA), Motion Picture Association (MPA), American Association of Independent Music (A2IM), Songwriters of North America (SONA), American Society for Collective Rights Licensing (ASCRL), Professional Photographers of America (PPA), Concept Art Association, and Stability AI have also voiced their support for this legislative effort.
The introduction of PADRA represents an ongoing effort by Rep. Issa within Congress to address challenges posed by generative AI technologies while ensuring ethical development practices remain intact.
